COVID-19 and ESG Remain Key Issues in Washington

In brief: Washington’s three branches of government, as well as state legislatures, share common concerns over COVID-19, diversity, the environment, and investment. Congressional bills focused on financial relief for businesses and liability protection for directors and officers. Diversity and inclusion gained a new edge with a bill on “anti-racism,” and California passed a new law mandating the inclusion of individuals from “under-represented” communities. In the environmental field, a partisan battle for more vs. less regulation continued. For its part, the US Securities and Exchange Commission set a higher bar for proxy advisors and proposed a streamlining of mutual fund annual reports that would take directors out of the spotlight, among other changes.
